Trade Mark

What is Trademark and Why It Matters

A trademark is more than just a logo or symbol; it represents your business's values, identity, and reputation.   If you register a brand name, tagline, or unique logo, you can legally protect it.   This registration gives the applicant legal ownership and the right to use the trademark only in India, where e-filing is currently available.

Businesses need trademark protection in FY 2026–27 because there is more competition between brands and brands are becoming more visible online.   The official IP India platform makes it easy for businesses and startups to file for a trademark for their business name, register a trade name, or protect their logo from anywhere in India.

Why You Should Register Your Trademark

A registered trademark not only makes your brand more trustworthy, but it also protects it from being used in ways that aren't right.   When companies don't protect their trademarks, they can lose customers' trust, have their domain name stolen, or have their products copied.

Some key reasons to invest in filing a trademark name are:

  • You Are the Only One Who Has Rights:  It is your legal right to use your brand name, logo, or slogan.

  • If people know your brand, they will keep coming back.

  • Legal Protection: If someone uses it without your permission, you can sue them.

  • Making things:  A registered trademark is an asset that can't be touched. You can license or franchise it.

Today, e-filing trademarks is faster, easier to keep track of, and safer, which means less time wasted on paperwork.

Documents Required for Trademark

It is quick and easy to register if you have the right papers ready. This is what you usually need:

  • Aadhaar, PAN, Passport, or Voter ID are all acceptable forms of identification.

  • A recent electricity bill, rental agreement, or driver's license can be used as proof of address.

  • You need either an incorporation certificate (for companies) or a partnership deed to show that you are in business.

  • A JPEG image of the logo or wordmark that is no larger than 100 KB.

  • User Affidavit:  If the mark is already being used for business, this is necessary.

  • Power of Attorney (TM-48):   When you file with a lawyer or agent.

Make sure that your business and trademark documents are the same so that your trademark application fee doesn't cause any problems or delays.

Latest Updates on Trademark Filing FY 2026–27

The Indian government has made it easier to file trademarks online for the fiscal year 2026–27 through the IP India portal.   People can now pay for trademark applications online and see how the registration process is going in India as it happens.

The official trademark application fee for individuals and small businesses is still lower than for large businesses. The cost of a logo trademark depends on the class and category.

Every ten years, you have to pay the trademark renewal fees to keep your brand safe.  If you miss the deadline, you have six months to pay extra trademark fees. The online renewal process makes it easy to keep your rights.

Benefits of Trademark

Registering your trademark gives your business lasting advantages:

  • The Trademark Act of 1999 protects you by law.

  • Stop people from using or copying things without asking first.

  • Customers will trust you more and be able to recognize you as a brand.

  • If you get permission, you can use the ® symbol.

  • More value for partnerships and investors in the brand.

Registering a trademark is more than just a formality; it's a way to keep your brand safe for a long time.   Filing for a trademark online is a quick and easy way for Indian businesses to protect their brand.  This will also help them keep up with changes to digital and legal rules in FY 2026–27.
